This Privacy Policy (“Privacy Policy”) describes the privacy practices related to the handling of Personal Information (defined below) of Joylab in connection with our Sites and Services and any other website or applications that we own or control and which posts or links to this Privacy Policy, and the rights and choices available to individuals with respect to their Personal Information. Capitalized terms not defined in this Privacy Policy are defined in our Terms of Service.

Joylab may provide additional or supplemental privacy policies for specific Services that we offer at the time we collect Personal Information. These supplemental privacy policies will govern how we may process such Personal Information in the context of the specific Service.

This Privacy Policy applies to all users of the Sites, including, but not limited to individuals who use, view, or otherwise access our Sites, and individuals who apply to Joylab or otherwise provide Personal Information to Joylab.

Personal Information you provide to us. “Personal Information” means any information relating to an identified or identifiable individual. You may provide to us through the Sites, Services or otherwise the following categories and specific pieces of information that, alone or in combination, may be Personal Information:

Information we obtain from other third parties. We may receive Personal Information about you from third-party sources such as marketing partners, social media and other cloud-based platforms, identity providers, publicly-available sources, business partners, and data providers.

Recruiting Information. If you choose to apply to work with or for Joylab through our Sites or by otherwise contacting us regarding opportunities to become an agent or contractor for us, we may collect the following:

Cookies and other information collected by automated means. We, our service providers, and our business partners may automatically log Usage and Electronic Information as set forth above. Referrals

Users of the Sites may have the opportunity to refer friends or other contacts to us or otherwise provide us Personal Information of others. You may only submit a referral or otherwise provide us Personal Information of others if you have permission to provide to us the individual’s Personal Information and by providing such information you represent and warrant that you have the authority to do so and to permit us and our service providers to use such information in accordance with this Privacy Policy.

How and Why We Use Your Personal Information

We may use your Personal Information, including as contained within your User Content, for the following purposes and as otherwise described in this Privacy Policy or at the time of collection:

To operate the Sites. We use your Personal Information to:

To send you marketing and promotional communications. We may send you Joylab-related marketing communications as permitted by law. You will have the ability to opt-out of our marketing and promotional communications as described in the What Are Your Choices and Text Message Terms sections below. We may use your personal information to develop our marketing plans and strategies for sending marketing and promotional communications to others.

For research and development. We may analyze use of the Sites to analyze and improve them and to develop new sites or services or to develop business and location expansion plans and we may use your User Content for product development purposes such as to create new beverages and as more fully set forth in the Terms of Service.

To process applications. We may use your Personal Information to review and evaluate your applications to work with or for Joylab or otherwise respond to you regarding opportunity inquiries.

To display advertisements. We may work with advertising partners to display advertisements on the Sites or elsewhere online. These advertisements are delivered by our advertising partners and may be targeted based on your use of the Sites or your activity elsewhere online. To comply with law. We may use your Personal Information as we believe necessary or appropriate to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities.

For compliance, fraud prevention, and safety. We may use your Personal Information and disclose it to law enforcement, government authorities, and private parties as we believe necessary or appropriate to: (a) protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); (b) enforce the terms and conditions that govern the Sites; (c) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity; and (d) conduct, complete, or respond to audits or audit results.

With your consent. In some cases we may specifically ask for your consent to collect, use or share your Personal Information, such as when required by applicable law.

To create anonymous, aggregated or de-identified data. We may create anonymous, aggregated or de-identified data from your Personal Information and other individuals whose Personal Information we collect. We process Personal Information into anonymous, aggregated or de-identified data by removing information that makes the data personally identifiable to you. We may use this anonymous, aggregated or de-identified data and share it with third parties for our lawful business purposes and as set forth in this Policy.

For other business purposes. Subject to this Privacy Policy, we may use your Personal Information to engage in other legitimate purposes as required or permitted by applicable law.

We may share your Personal Information, including as contained within your User Content, with third parties as described below:

Service providers. We may share your Personal Information with third party companies and individuals that provide services on our behalf or help us operate the Sites (such as hosting, email delivery, marketing, payment processing, provision of support, and data management). These third parties may use your Personal Information only as directed or authorized by us and in a manner consistent with this Privacy Policy, and are prohibited from using or disclosing your information for any other purpose.

For compliance, fraud prevention and safety. We may share your Personal Information for the compliance, fraud prevention, audit, and safety purposes described above.

We may transfer or otherwise share some or all of our business or assets, including your Personal Information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution.

Affiliates. We may share your Personal Information with current and potential corporate parents, subsidiaries, affiliates, and franchisees for purposes consistent with this Privacy Policy.

With your consent. We may otherwise share your Personal Information with your consent or pursuant to your instructions.

With other users. We may share your Personal Information as part of the Sites’ operation and depending on certain Site features you and other users elect to use.

For other business purposes. We may share your Personal Information for other legitimate purposes as required or permitted by applicable law.

For How Long Do We Retain Personal Information

We retain Personal Information for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of providing you the Sites, the Services, and support for prior Services provided to you, satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes, and otherwise as permitted by law.

To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements.

When we no longer require the Personal Information we have collected about you, we will either delete or anonymize it or, if this is not possible, securely store it in accordance with this Privacy Policy and cease use of the Personal Information until deletion is possible. If we anonymize your Personal Information (so that it can no longer be associated with you), we may retain this information for longer periods. What Security Practices Do We Implement

We are committed to protecting your Personal Information. Joylab implements technical and organizational measures designed to secure Personal Information. In assessing the appropriate level of security, Joylab took account of the risks that are presented by processing this information, in particular risks from accidental or unlawful destruction loss, alteration, unauthorized disclosure of, or access to Personal Information transmitted, stored or otherwise processed by Joylab. However, security risk is inherent in all internet and information technologies and we cannot guarantee the security of your Personal Information.

If we learn of and confirm the occurrence of a security incident leading to the misappropriation or accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, your Personal Information transmitted, stored or otherwise processed on our systems that compromises the confidentiality, integrity or availability of your Personal Information, we may attempt to notify you electronically by posting a notice on our Site or by sending you an email or otherwise in accordance with applicable law.

What Are Your Choices

In this section, we describe the rights and choices available to you in how we process your Personal Information.

Choosing not to share your Personal Information. You may choose not to provide Personal Information, including when creating and providing User Content or with regard to location information described above. If you choose not to provide Personal Information (or ask us to delete it), we may not be able to provide you with our Services or parts of our Services. We will tell you what information you must provide to receive the Service you’ve requested by designating it as required at the time of collection or through other appropriate means. Opt out of marketing communications. You may opt out of marketing-related email and text messages by following the opt-out or unsubscribe instructions in the communication, or by contacting us at privacy@joylabhq.com, or for text messages, as set forth in the Text Message Terms below. If you opt out of marketing communications, you may continue to receive Service-related and other non-marketing emails.

Cookies & browser web storage and targeted online advertising. We may allow service providers and other third parties to use cookies and similar technologies to track your browsing activity over time and across the Sites and third-party websites or applications. If business partners collect information about your activities on or through the Sites, they may be members of organizations or programs that provide choices to individuals regarding the use of their browsing behavior or mobile application usage for purposes of targeted advertising. Do not track. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” or similar signals. To find out more about “Do Not Track,” please visit www.allaboutdnt.com.

Credit Card Information. Third Party Services (defined below) may collect and use your credit card information to complete transactions for Services you purchase. These Third Party Services may save your credit card information for your convenience to ease the purchasing process for subsequent transactions. Joylab does not collect, use, or store your credit card information. You may be able to configure these Third Party Services to change or remove your saved credit card information in accordance with the terms of those Third Party Services.

Text Message Terms

If you elect to receive text messages, we will send you text messages regarding your account activity, transaction activity, promotions, and other news and information about us. If you do not agree to these Text Message Terms, you can turn off text message notifications in your account settings on the website or in the app. You can also order directly from a barista and not provide your phone number. Your wireless carrier may assess certain fees or charges associated with your use of text messaging. We are not responsible for such fees. Your carrier may restrict or prohibit certain mobile features and certain mobile features may be incompatible with your carrier or mobile device. Our text message program applies only to mobile devices registered in the United States and with United States carriers. Please review your wireless carrier’s policies and contact them if you have any questions. Consent to receive text messages is not a condition of purchase. You acknowledge that you are at least eighteen years of age and you have the consent of the wireless account holder to sign up for text messages and pay for any related fees. We may use an automatic dialing system or automated number selection system to send you text messages. We are not liable for any delays in the receipt of any text messages. Delivery is subject to effective transmission from your network operator. You are responsible for updating your number with us and ensuring your account information is correct. Messages may be sent via SMS or MMS messaging. Text messages may be promotional or transactional (in response to your purchases, for example) in nature. For each transaction, we may send approximately four messages. We may additionally send approximately one to three promotional messages per month.

You can cancel our text message alerts at any time by texting “STOP” in response to the text message you received after which we will send a text message to confirm that you have been unsubscribed. After this, you will no longer receive text messages from that particular number. If you want to receive our text alerts again, respond to the unsubscribe confirmation with START or change the phone number in your account and we will start sending text alerts to you again. If at any time you forget what keywords are supported, text “HELP” to the text message you received and you will receive instructions on how to use our service as well as how to unsubscribe. You can also turn off and turn on text message notifications in your account settings on the website or in the app. Please contact us as set forth below with any questions regarding our text messages.

Other Sites, Mobile Applications and Services

The Sites may contain links to other websites, mobile applications, and other online services operated by third parties such as social media companies, payment processors, mapping websites or applications, messaging websites or applications, or media and music websites or applications (“Third Party Services”). These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on Third Party Services. We do not control these Third Party Services, we are not responsible for their actions, and they may follow different rules regarding the collection, use and sharing of your Personal Information. We encourage you to read the privacy policies of Third Party Services you use.

Your California Privacy Rights

Though we do not offer Services in California and we have no offices or business operations in California, if you are a California resident and provided us your Personal Information, the below California-specific provisions may apply to you.

“Shine the Light” Law

If applicable to us at the time of your request based on certain exemptions and exceptions that may be available, California residents may request certain information regarding our disclosure (if any) of personal information to third parties for their direct marketing purposes, pursuant to California Civil Code Section 1798.83 (the California “Shine the Light” law). To make such a request, please contact us, identify yourself as a California resident and provide sufficient information in accordance with the Shine the Light law so we can take appropriate action, such as your name, email address, and any additional information required.

Personal Information of Children and Minors

The Services are not directed to individuals under the age of 13 and such individuals are not permitted to use the Sites, and we do not collect Personal Information from them.

If we learn that we have collected Personal Information of individuals under the age of 13 without the consent of their parent or guardian, we will delete it. If you have determined that we have processed such Personal Information or have any questions related to our processing of Personal Information of individuals under the age of 13, please contact us as set forth below.

Transfers of Personal Information Outside the European Economic Area

Our Sites are not directed to or intentionally made available to anyone outside of the United States, we do not have any offices or business operations outside of the United States, and you must be located in the United States to use our Services. We do not offer Services outside of the United States.

Changes To This Privacy Policy

The Privacy Policy can change over time, for example to comply with legal requirements or to meet changing business needs. The most up-to-date version can be found on this webpage. In case there is an important change that we want to highlight to you, we will also inform you in another appropriate way if and as required by law (for example via a notice or banner on our website, or via email to you).
